1. General Information

Breuninger takes data protection regulations and the safeguarding of your personal data very seriously. Breuninger is well aware that confidence plays a vital role in its relationship with its customers and the overall success of its business. By fulfilling its information obligations as effectively as possible, Breuninger aims to live up to the expectations placed on it. 

For this reason, this Data Protection Statement details the extent to which Breuninger gathers personal data when customers visit its websites, use its mobile apps or provide data in other areas, how this data is processed and the purposes for which this data is used. 

This Data Protection Statement applies equally to these online portals operated by E. Breuninger GmbH & Co. ("Breuninger"):

The www.e-breuninger.de portal is an information portal for the company Breuninger.

The www.breuninger-outlet.de website is an information portal for the Breuninger Outlet. www.karls-kitchen.de is the portal for the Breuninger restaurant, (karls)kitchen, and www.sansibarbybreuninger.de is the website for Sansibar by Breuninger. You will find more information about Breuninger's services at www.breuninger-confiserie.de and www.e-breuninger.de/DieFriseure‎.

Breuninger also processes personal data outside these applications in the context of Breuninger Card customer relations, in the Human Resources /Personnel department and the Breuninger hair salons, our Special Service and other services. All these areas are subject to the data protection declarations and information detailed in these areas and in point 12. Information sheets about other services, insofar as general information such as the person responsible for data processing, the Company Data Protection Officer and the regulatory body and the information about the rights of data subjects is not covered in these places.

This Data Protection Statement uses the same terms and definitions as Art. 4 of the EU General Data Protection Regulation. "Personal data" is one of the most important terms and means any information relating to an identified or identifiable natural person. This includes, for example, their name, address, telephone number, e-mail address, ordered goods, payment data etc., which has been gathered either online or offline.

Breuninger's operational Data Security Officer can be contacted by anyone by e-mailing datenschutz@breuninger.de.

If you have a concern about the way your data is being processed, contact the relevant regulatory authority: Landesbeauftragte für Datenschutz und Informationsfreiheit (meaning: State data protection and freedom of information office). 3. Your rights as the data subject

As the data subject, you have the right to request information about the personal data that affects you as stated in Art. 15 GDPR. As stated in Art. 16 of the GDPR, you have the right to correct the data held about you or, if the conditions detailed in Art. 17 of the GDPR are present, request that this data is deleted. You also have the right to limit the extent to which your data is processed (Art. 18 GDPR). If you can prove that you have a special personal situation, you can object to the processing of your data in general or in specific areas (Art. 21 GDPR). You have the right to receive a copy of the data you have provided us in a commonly used format (Art. 20 GDPR).

You will find more detailed information about your rights in our Information sheet about the rights of data subjects in accordance with GDPR.

If you have given consent for us to process your data, you can withdraw this at any time. To do so, please contact kundenservice@breuninger.de. Please note that the withdrawal of consent will only affect future activities and any processing performed before then will therefore not be unlawful.

4. Legal basis for processing personal data

Any requests for consent from the data subject for the processing of their personal data will be based on Art. 6 Para. 1, Item a of the EU General Data Protection Regulation (GDPR).

When processing personal data to fulfil a contract where the data subject is the contractual partner, Art. 6 Para. 1, Item b GDPR will be used as the legal basis. This also applies to processes required to perform precontractual measures.

When processing personal data to fulfil a legal requirement to which our company is subject, Art. 6 Para. 1, Item c GDPR will be used as the legal basis.

When it is necessary to process personal data in order to protect the vital interests of the data subject or of another natural person, Art. 6 Para. 1, Item d GDPR will be used as the legal basis.

If processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, which require protection of personal data, Art 6 Para. 1, Item f GDPR will be used as the legal basis for processing. 

We will specify the legal basis and, if necessary, our authorised interests in all the data processing procedures listed below.

5. General information about the use of our websites and mobile applications

You can visit all our websites or use our mobile applications without having to log on or identify yourself. 

5.1. Log data

Your data will be saved temporarily in log files to ensure the website functions properly. We will also use this data to optimise the website and to ensure the smooth running of our information technology systems. 

This information includes:

  • IP address
  • Date and time
  • Website page/name of the file called
  • Amount of data transferred
  • Message stating whether the access/call was successful

This data will not be analysed for marketing or other purposes.

5.2. Newsletter request online and contact forms

You can also subscribe to our Newsletter when you apply for your Breuninger Card. For more information about this, go to https://www.e-breuninger.de/de/breuninger-card/card/.  

Since July 30th 2018, we have offered the option of subscribing to a personalised Newsletter using your user profiling data. You will find more detailed information about this in the information sheet in point 12. Information sheets for other services. Your user profiling data will not be used if you subscribed to our Newsletter before July 30th 2018. 

You can request our Newsletter without having to register or purchase goods. After you send in your request, you will receive an e-mail asking you to confirm that you have actually requested the Newsletter. We will not send you our advertising Newsletter until we receive this confirmation. Your consent is the legal basis on which we will process your data. You can unsubscribe to the Newsletter at any time, free of charge, by sending an e-mail to kontakt@breuninger.de or kundenservice@breuninger.de. Every Newsletter also includes a link for unsubscribing from it.

You can also send in any questions you have about the Breuninger Card or any other issues by filling in the contact forms on our portals. The data you provide in these cases will only be used to respond to your questions and on the basis of your and our mutual interest. 

If you have registered and logged in, or entered your Breuninger Card number, your queries and our responses will be saved in your customer account or card account and deleted after a maximum of 36 months. We shall save the data provided for other queries until the query has been processed.

6. The processing of personal data for in-house market research, opinion polls and advertising

We shall only use your personal data to the extent legally defined for in-house market research and for advertising. 

Having given their consent, Newsletter subscribers will receive our Newsletter at regular intervals and can withdraw their consent at any time. The data they provided to give their consent will then be deleted. We shall only contact you by telephone or e-mail about promotions and offers if you have expressly given your consent for this. 

We will not give your data to third parties for promotional purposes. 

You can object to this use of your data or withdraw your consent at any time. In this case, either send an e-mail to Kundenservice@breuninger.de or write to E. Breuninger GmbH & Co., Kundenservice, Marktstraße 1-3, 70173 Stuttgart, Germany or send a fax to +49 711 211 - 3053. Your data will then be blocked for promotional use as you request. 

6.1. Medallia & Qualitize (in-house market research and opinion polls)

We have engaged the market research agency Medallia, Inc., headquartered in San Mateo, California, USA, and Qualitize GmbH, headquartered in Hamburg, Germany, to carry out surveys on our behalf. 

As a Breuninger Card customer, every time you make a purchase in one of our stores, we will send you an e-mail the next day inviting you to give us feedback about your visit. You can also provide feedback in our sales areas or in the Breuninger Online shop. 

The data we gather from feedback is used exclusively in-house so that we can further improve your shopping experience with us. The data will be stored on servers in Europe (United Kingdom and Germany). In exceptional cases, this data may be transferred to servers in other EU Member States during processing. However, our contractual agreements ensure that data is always processed in compliance with EU data protection regulations.

Medallia and Qualitize support us exclusively by processing the questionnaires you have completed. The data is returned exclusively to ourselves. All the data is used exclusively with your consent. 

By participating, you give your consent for the contact data and feedback about purchasing experiences you provide to be gathered, stored and evaluated by Medallia and Qualitize for Breuninger, and for the results of the evaluation to be returned to Breuninger together with the data you have provided. You can withdraw your consent at any time, and this will apply in the future. 

If you have provided your contact data, we will use it in close conjunction with the survey, to help us if we have any queries about your responses. It will then be deleted. 

We require Medallia and Qualitize to adhere to stringent regulations when processing your personal data, including a duty to use this data exclusively as instructed by Breuninger and in compliance with the applicable legislation.  

7. Cookies & tracking technologies

We use cookies on a number of web pages to make your visit to our website as pleasant and enjoyable as possible. Cookies also enable us to run particular functions. Cookies are short text files that are saved to your end device and which save specific settings and data which can then be exchanged with our system via your browser.

The cookies we use are described in greater detail below.

1. Analysis & statistics: As part of our on-going efforts to improve the user-friendliness of our website, we use cookies that anonymously measure and evaluate which functions and web page contents are used most often, and how much they are used. This helps us identify which contents and products in our web pages users are particularly interested in. 

2. Required cookies: Required cookies help us to make our website technically accessible so you can use it easily. Cookies enable us to provide essential basic functions, such as navigating through the web pages, displaying information correctly in your Internet browser and managing your consent. Our website cannot function without these cookies. 

You can either agree to the use of all coolies or make your own selection. 

You can, of course, set your Internet browser to ensure it never accepts the use of cookies. Information about how to do this can usually be found in the Help function in your Internet browser. However, if you decide not to accept the use of cookies, this may limit the functions you are able to access on the Breuninger company website. 

8. Notify and MessengerPeople (communications services)

Breuninger gives Breuninger Outlet customers the option of communicating by Notify. After you have registered for Notify, you will receive a regular Newsletter with the latest information about the Breuninger Outlet. You can unsubscribe from our Newsletter at any time. Simple write "Stop" in the Notify chat and we will stop sending messages to you.

You must install the Notify app before you can receive the Newsletter via Notify. By subscribing to our channel, you agree to adhere to Breuninger's in-house data protection regulations. In particular, as described in Art. 6 Para. 1, Item a GDPR, you give consent for your personal data (name and first name, telephone number, Messenger ID, profile picture and messaging history) to be saved, processed and used by the messaging service (Notify) to send messages to you. Breuninger has engaged the company MessengerPeople GmbH, Herzog-Heinrich-Str. 9, 80336 Munich, Germany as the technical service provider that will provide this service and processes the associated jobs.

If you no longer want to use our Notify service and want to ensure that all the data relating to you is deleted, simply write the message "Delete all data" in the Notify chat. All the data held by our service provider, MessengerPeople, will then be deleted.

9. Integration of Youtube videos

Data content from Youtube is integrated in this website. Youtube is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Extended data protection setting is enabled for Youtube videos that are integrated on our website. This means that Youtube does not gather information from visitors to our website unless they play a video.

When playing a Youtube video, you can also prevent tracking cookies from being implemented by making a setting in your browser software (as described above) that prevents cookies from being saved. However, if you do so, we cannot guarantee you will be able to use all the functions on this website to their full extent.

Please refer to the data protection information provided at https://www.youtube.com/static?template=privacy_guidelines to find out more about how much data is gathered, processed and used by the provider, and for what purpose. These guidelines also detail your rights in this regard and the setting options you can implement to protect your privacy.

10. Competitions

You have the opportunity to enter a range of different competitions, either on our website, in our Newsletter, at various events and promotional activities in Breuninger stores or via the Breuninger app. Unless stated otherwise in a particular competition, or if you have not expressly granted us consent, we will use the personal data you provide us as a participant in the competition exclusively for the purposes of running the competition (for example, deciding the winner, informing the winner or sending out the prize). Legal basis for processing data as part of a competition is Article 6 Para. 1 Letter b) of the GDPR. If a declaration of consent in the context of a competition is provided, the legal basis for processing data on the basis of this declaration will be Article 6 Para. 1 letter a) of the GDPR. If you have given your consent as part of participating in a competition, you can withdraw this consent at any time with effect for the future.

In competitions which require online participation, your personal data will be forwarded exclusively to Google LLC, USA (Adequacy agreement or suitable or appropriate guarantees for data transfer to third-party countries and/or international Organizations:  EU-US Privacy Shield certification) for processing and the automatic selection of the winner. Your data will not be passed on to any other third parties. 

The personal data of participants who did not win will be deleted at the end of the competition, after the winner has been announced. The winner's data will be saved for the duration of the competition and also for the duration of the legal retention periods specified in the German Commercial Code (Handelsgesetzbuch: HGB) and German Tax Code (Abgabenordnung: AO). If the prize is merchandise, the winner's data will be saved for the period that legal claims against warranty can be made, so that the prize can be repaired or replaced if defects are identified.

The provision of personal data is not a legal or contractual prerequisite. However, it is a requirement for participating in the competition. Failure to provide personal data will prevent participation in the competition. The competitions do not involve any automated decision-making processes, including profiling. 

11. Data security

We implement the latest technical measures to ensure data security, in particular, to protect your personal data from the risks involved when being transferred and to prevent it from falling into the hands of third parties. 

Our data security policy is constantly being updated to reflect the latest technological developments. We use Standard Secure Sockets Layer (SSL) to encrypt the personal information you provide on our website.
